Lynn Haven Police Reports For Week Of March 20 (With Mugshots)

Incident # 13-03028
On 03/14/2013 at about 1607 hours I was patrolling the northbound lane of the Bailey Bridge when I observed a white Dodge station wagon  bearing Florida license plate number 063NWJ directly in front of me. I ran the tag number through NCIC / FCIC it returned to a green Dodge.

I initiated a traffic stop by turning on my overhead emergency blue lights.

The vehicle came to a stop in the parking lot of Emerald Gymnastics located at 6446 Highway 77.   I approached the vehicle and made contact with the driver, Bruce S.  Allcox and his passenger and registered owner Debbie H. Moseley.

I advised Allcox of the reason for the stop. Allcox told me the vehicle used to be green but was recently painted white. I confirmed the vehicle identification number on the vehicle with the vehicle identification number on the registration and they did match.

I requested Allcox’ driver’s license and registration. I returned to  my vehicle and ran Allcox drivers license through NCIC/FCIC. It showed that Allcox driver’s license was suspended as of 01/02/2013 for delinquent child support. I then ran Allcox drivers license through D.A.V.I.D, it showed he was given a notice for the suspension.

I completed criminal citation number 0312-GRM charging Allcox with driving while license suspended with knowledge. I informed Allcox of his court date on 04/03/2013 at 0830 hours. He told me he understood and provided his signature on the citation. I allowed Moseley, who had a valid driver’s license drive the vehicle from the scene. I took into possession Allcox driver’s license and it will be attached to this report along with the criminal citation.

 

Incident # 13-03048
On 3/14/13 at approximately 1931 hrs, I was driving southbound on S.R. 77 approaching Peachtree Dr. At that time I observed a vehicle in front of me bearing Alabama 3A62V71 driving with no lights on.   I initiated a traffic stop pulling in to the Walmart parking lot. I made contact with Jasmine A. Moss, the driver. Moss handed me her Alabama driver license and the rental agreement of the vehicle she was driving.

The rental agreement contained a law enforcement alert on the front “If any Law Enforcement stops this vehicle for any reason and the driver is not the person on the rental agreement, treat this vehicle as stolen, tow it an impound yard and contact us.”

The vehicle was rented to Samantha Rozelle Lucas who was in the back seat. Also in the vehicle were Dominique Williams, Tina Marie Jones and Keanne Santana Alexander.

I asked Lucas why she was not driving the vehicle, she stated her stomach hurt. Cpl Nusbaum and Sgt Hamilton arrived shortly after. Sgt.  Hamilton advised me to submit a report on this incident and notify the rental company. The company was closed but I left a detailed message and my contact information. I cited Moss for driving without headlights in dark conditions and allowed Lucas to drive the car from the scene.

 

Incident # 13-03079
On 03/15/13, at approximately 1136 hours I was traveling southbound on SR 77 directly behind a blue Chevrolet truck bearing Florida tag SJJ0B. I entered the tag information into FCIC/NCIC and DAVID. I noted that the registered owner, Christopher Fernandez’s license was not valid due to a financial responsibility. Both systems also advised for Florida Authorities to seize tag if driver was owner of the vehicle.

Using the drivers license photo in DAVID, I noted from the reflection in the side mirrors that the driver was Fernandez. I initiated my emergency lights and made contact with the driver who I confirmed was Fernandez by his Florida license. I advised Fernandez of my reason for stopping him and he advised that he did not know his license was suspended.

I explained and issued Fernandez a criminal citation for DWLSR financial responsibility. I then removed the tag from the vehicle. Fernandez’s tag and drivers license will be attached to this report.  Nothing further.

 

Incident # 13-03104
On 3/15/13 at approximately 1815 hours, I was dispatched to SR 77 and 24th Street in reference to a vehicle crash, reference crash number 12889528. I made contact with Anthony White. He identified himself as one of the drivers involved in the crash.

I asked White for the required information, and he stated he did not have a drivers license due to suspensions. I collected his personal information and identified him with the use of DAVID. I delivered the information to dispatch, and she confirmed his drivers license status.

I completed the required paperwork for the vehicle crash. I delivered the form to both drivers.  I advised White he was under arrest for driving while license suspended with knowledge. I placed him in double locked handcuffs and  escorted him to the rear of my patrol car. I transported him to the Bay County Jail without incident.

I delivered a criminal citation for the above offense, and a civil citation for careless driving. He signed both and delivered a right thumb print. He was then released to the staff there.  Nothing further.

 

Incident # 13-03126
On 3/16/2013 at 0228 while patrolling in the area of Jenks Ave. and Bradford Cir. I observed a black male, later identified by his Florida ID card as Fred Houston, walking south in the road with the flow of traffic.

I made contact with Houston and advised him of the reason for the contact.

Houston stated he was walking home from the store. I asked Houston for ID, Houston, produced a Florida ID card. Upon running his information through the FCIC/NCIC the return advised Houston held an active warrant for Bay County.

I confirmed the information through dispatch.   Houston was placed in double locked hand-cuffs and transported to the Bay County Jail without incident.

 

 

 

Incident # 13-03127

On 3/16/13 at approximately 0258 hours, I was patrolling in the 2100 block of Country Club Drive when I observed a silver GMC van traveling westbound in the above listed block.

I noted the van did not have a functional tag light. I turned around to stop the vehicle, and it immediately accelerated rounding a curve. I caught up to the vehicle and initiated my overhead lights in the 1400 block of Country Club Drive. As the vehicle was coming to a stop, I detected a strong odor of cologne coming from the vehicle.

The vehicle came to rest in the 1400 block of Country Club Drive.   I made contact with the driver identified as Daniel Jackson by his Florida drivers license. I immediately detected a strong odor of green marijuana emitting from the vehicle. I asked Jackson for the required information. I noted Jackson had his eyes open as wide as possible, and they were blood shot.

He continued sticking his tongue out as he talked and moved his jaw from side to side. I noted he had extreme dry mouth to
the point it was affecting his speech. I noticed his movement was extremely fast to the point it was uncontrolled. Jackson attempted to open his visor but moved so fast he hit the roof with his hand.

I asked Jackson to step out of the vehicle. Jackson did so and used a jumping motion to exit causing his cellular phone in his lap to fly into the middle of the roadway. I advised him I detected a strong odor of marijuana emitting from the vehicle. I patted him down for weapons and advised him to sit on the bumper.

I then made contact with the passenger, Tyler Niquet. I noted his movement was extremely slowed, his eyelids were drooping, and his eyes were extremely red. I patted Tyler down for weapons and advised him to sit on the bumper of the vehicle. I advised both of the occupants I was going to search the vehicle for any type of illegal narcotics. Ofc. Landingham arrived, and I began the search.

I located a Walgreens pill bottle in the center console of the vehicle with a black and green tar like substance inside. I also noted a plastic dish with a green leafy substance on top along with the same type green leafy substance throughout the vehicle. I located one pack of JOB rolling papers in the center console, and one pack of French White rolling papers in the rear seat.

I removed the contents of the center console and discovered a small amount of the green leafy substance in the bottom. I removed the substance and placed it into the pill bottle. The substance was later field tested for marijuana with positive results. I advised both parties of my finding, and Jackson immediately advised the substance was his.

Due to Jackson’s behavior, I asked him if he was willing to perform the standardized field sobriety exercises to determine if he was able to operate a motor vehicle. He advised he would. I asked Jackson if he had any medical problems, and he advised he did not. I asked him if he had anything wrong with him that would affect his balance, and he stated no.

The first exercise was the horizontal gaze nystagmus. I advised Jackson to stand with his feet together and hands by his side. I advised him to follow the stimulus with his eyes and eyes only, and he agreed. I noted Jackson’s pupils were extremely dilated. I noted Jackson had equal pupil size and equal tracking throughout this exercise. I noted Jackson was swaying from front to back during this exercise.

This exercise rendered six clues of impairment, lack of smooth pursuit in both eyes, distinct and sustained nystagmus at maximum deviation in both eyes, and onset of nystagmus prior to 45 degrees in both eyes.  The next exercise was the nine step walk and turn. I advised Jackson we would use a crack in the center of the road, and he agreed. I advised Jackson to place his left foot on the line and his right in front of his left touching heel to toe. I advised his keep his hands by his side and remain in that position until I instructed him to begin and he agreed.

I advised him to take nine steps heel to toe down the line. When he reached his ninth step, leave his front foot on the line, and take several small steps with his rear foot to turn around. Then take nine heel to toe steps back down the line. I asked Jackson if he understood the direction, and he stated he did and immediately began. I advised him to return to the starting position until I instructed him to begin.

He complied but lost his balance attempted to get back in that position causing him to raise his arms and stumble backwards. It should be noted Jackson raised his arms during the instruction phase and lost balance causing him to remove a foot from the line on two separate occasions. I advised Jackson to begin.

I noted Jackson missed heel to toe with a distance greater than one half inch on steps 1,2,4,7 of the initial walk, and he missed heel to toe on steps 3, 4,5,7,8 of the return walk. Jackson also made an improper turn by removing both feet from the line to turn around. I noted he raised his arms with a distance greater than six inches from his body throughout the exercise. Jackson also did not count his steps out loud as instructed.

The next exercise was the one leg stand. I advised Jackson to stand with his feet together and his hands by his side. I advised him to raise one foot, either foot, six inches off the ground, look at his raised foot, and count one thousand and one, on thousand and two, and so on until I instructed him to stop. I advised him to keep his hands by his side during this exercise. Jackson advised he understood the instructions. I advised Jackson to begin and he raised his left foot and his arms.

I advised Jackson to return his hands to his side. He did so and immediately returned his foot to the ground. He raised his left foot once more, lost his balance, raised his arms, and put his raised foot behind his body to regain his balance. He attempted once more and returned his foot to the ground before 30 seconds had passed. I noted Jackson was swaying from back to front during the exercise.

The next exercise was the Rhomberg balance. I advised Jackson to stand with his feet together and his hands by his side. I instructed him to stay in this position and not to begin until instructed to do so. I advised him to tilt his head back and estimate the passage of 30 seconds.

Jackson immediately began the exercise without instruction. I advised him to look back at me and wait for instruction. Jackson advised he understood the instruction and began the exercise. Jackson tilted his head back forward after the passage of 24 seconds.

Due to the totality of the circumstances, I advised Jackson he was under arrest for driving while impaired, possession of marijuana, and possession of drug paraphernalia. I placed him into double locked hand cuffs and escorted him to the rear of my patrol vehicle. Ofc. Landingham completed the inventory of the vehicle for tow. I transported Jackson to the Lynn Haven Police Department to obtain a breath sample.

I operated the Intoxilyzer 8000, and Jackson provided two samples with results of 0.090 and 0.098. Jackson was read Miranda Warnings from a pre written form. He verbally waived his rights. He stated he had smoked marijuana only a few minutes prior to the traffic stop. Jackson did not sign the Miranda form or implied consent form but verbally agreed to both.

Ofc. Landingham made contact with me at the Police Department and delivered a silver cylinder used to grind marijuana. The cylinder contained the same type substance seized from the vehicle. I showed the items to Jackson, and he stated it was his marijuana grinder after Miranda Warnings were read. Ofc. Landingham submitted the cylinder into the property room as evidence. I submitted the other items into the property room as evidence.

I transported Jackson to the Bay County Jail without incident. Jackson was charged with driving with an unlawful blood alcohol level, possession of marijuana, and possession of drug paraphernalia. He was released to the staff there. Nothing further.

 

 

Incident # 13-03133
On 3/16/13 at 11:00 I was dispatched to the Lynn Haven Library located at 901 Ohio Avenue in reference to the theft of a bicycle.

Upon arrival I made contact with the complainant James McCrory who stated that he parked his bicycle at the rear entrance of the library at 10:10 and went inside. Mr. McCrory went on to say that when he exited the library at 11:00 his bicycle was gone.

It should be noted that he bicycle was not secured at the time of the theft. Mr. McCrory does not know who would have taken the bicycle and was unable to provide direction of travel.

A search of the area was made with negative results. No physical evidence was collected from the scene and the bicycle was entered into FCIC/NCIC as stolen. No further information at this time.

 

 

Incident # 13-03138
On 03/17/13, at approximately 1517 hours, I was on 9th Street at the intersection of SR 77, stopped in traffic behind a blue ford van, bearing Florida tag BB4IPJ. I noted that one of the vehicles brake lights would flicker off and on as if there was an electrical issue with the light.

I entered the tag information in NCIC/FCIC and saw that the tag on the van was supposed to be attached to a maroon GMC truck. As the vehicle turned northbound on SR 77, I initiated my emergency lights and the vehicle came to a complete stop in the 100 block of E 8th Street.

I exited my vehicle and made contact with the driver, Richard Rogers and passenger Pamela Woods. I advised him of my reason for the stop and he stated that he knew the tag did not belong on the van, but because his GMC truck was disabled, he took removed the tag from the truck and placed it on the van. He added, he recently purchased the van from his employer, Sowell Enterprise Incorporated and has not registered the vehicle in his name.

Rogers had no proof of ownership inside the vehicle. I provided dispatch with the Vehicle Identification Number on the van, which confirmed it was still registered to Sowell Enterprise Inc in Graceville, Florida. I later attempted to make contact with the business, but was able to reach anyone.

I asked Rogers for his license and he stated he did not have it with him. I then asked if he had a valid license and he stated, “no, its suspended for letting my insurance lapse.” I provided dispatch with Rogers information and they confirmed his license was suspended.

I collected Woods personal information and provided it to dispatch. Dispatch advised she had a warrant from this county in reference to child support. The warrant was under Woods maiden name Pamela Brewer. I had Rogers exit the vehicle first and advised him he was under arrest for knowingly driving with a suspended license and attaching tag not assigned.

I placed him in double-locked handcuffs and secured in the rear of my patrol car. I then had Woods exit and advised her of the warrant. She was placed in double-locked handcuffs and also secured in the rear of my patrol vehicle.

While Ofc. Michaels stood by, I completed an inventory search of the van and tow truck by rotation was called to remove the van from the scene.

The van was removed by Discount Towing and will be placed in their yard located at 2798 E Business 98 in Panama City, FL.

Both Rogers and Woods was transported to the Bay County Jail without incident. All information pertaining to this case will be attached to this report. Nothing further.

 

 

Incident # 13-03147
On 3/16/13 at approximately 2211 hours, I observed a red Chevrolet SUV bearing Florida tag BJFQ22 traveling northbound in the 600 block of SR 77. I caught up to the vehicle on the Bailey Bridge and ran the tag with the use of DAVID. I discovered the tag was registered to a trailer.

I caught back up to the vehicle and confirmed the tag. I then initiated my overhead lights for the offense and the vehicle slowed but continued driving until it could cross the southbound lanes of SR 77. The vehicle stopped at the intersection of Buchanan Road and SR 77.

I made contact with the driver identified as David Elmore Jr by his Florida drivers license. I advised him the tag did not belong to the vehicle, and he stated he knew the tag did not belong to the vehicle. He advised his father gave him the tag for the vehicle, and he told him it did not belong on the vehicle.

Elmore advised the vehicle was not registered. I gathered the VIN and delivered all the information to dispatch. I then issued Elmore a criminal citation for attaching tag not assigned with a court date of 4/3/13 at 0830 hours. He delivered a signature and thumb print acknowledging the date. He was released on scene. Nothing further.

 

Incident # 13-03150
On 3/16/2013 at 2252 I was dispatched to 1910 Pattho Ln. Apt# B107 in reference to a domestic battery. Upon arrival I made contact with John Thomas who stated the following. Tonight he was attacked by his wife Toccara Thomas. He stated Toccara drove from Pensacola FL to his residence and began accusing him of cheating on her.

When John told her to leave she began to strike him in the face and upper torso area with a closed fist. John advised he was able to grab her and stop her from hitting him and move her outside the residence. Once outside three of his roommates, Gabrielle Gardner, Khristina Watters, and Terren Austin, were able to break the fight up between him and Toccara.

At this time Toccara went to the Ford Taurus they own and punctured a hole with an unknown sharp object in the rear driver side tire causing it to go flat. Toccara then proceeded to rip the tag off the rear of the vehicle but was stopped by John. Toccara returned to the vehicle she drove to the residence, a Chrysler Town & County van.

Upon leaving the residence Toccara attempted to hit John with the vehicle. John advised he was able to avoid the vehicle then he kicked the driver side mirror off of the vehicle and went and got a tire iron out of the Taurus. Toccara again attempted to hit John. During this attempt she ran over his left foot. John advised he struck the windshield of the vehicle to get the vehicle off his foot.

When Toccara drove off John’s foot she ran over a cable box in the front yard of the residence. Toccara then left the scene, at which time Gabrielle called the police. I asked John several times if he required medical attention he stated “no”. It should be noted John had no visible wounds, John, only advised he was sore from the altercation.

After speaking with John I spoke with all of John’s roommates separately. All three has the same story as John on the above incident. I had John, Gabrielle, Khristina, and Terren all provide me with witness statements on the above incident. John was given domestic violence information and he signed the Notice of Legal Rights form.

John also provided me with information to make contact with Toccara. Several pictures were taken of the damage done to the Taurus and placed in the media section of this report. I noted while taking photographs of the scene a knife located about 10 feet from the Taurus with the blade broken off. At this time I am unable to determine if the knife was used by Toccara to puncture the tire.

The knife was collected and placed into evidence to be processed for latent prints. Upon returning to my patrol car I was able to make contact with Toccara over the telephone. Toccara advised she was attacked by John and she did not run over the cable box. I asked Toccara to meet me at Police Station 1. She advised she could not tonight but could on Wednesday. I advised the severity the situation to her but she still refused to meet with me.

A Complaint Affidavit has been completed for the charges and a warrant has been filed against Toccara Thomas.

 

 

Incident # 13-03168
On 03/17/13, at approximately 1203 hours I was traveling southbound on SR 77, directly behind a yellow Dodge truck bearing Florida tag BKFJ48. As we came to a complete stop at the intersection of Baldwin Road, I noted the vehicle had one operating brake light.

Once the light turned green, I initiated my emergency lights and the vehicle came to a complete stop in the parking lot of the Healthplex, 2933 S Highway 77. I exited my patrol vehicle and made contact with the driver, Destin Mckay.

I also noted that Mckay had a child under the age of three sitting in the backseat of the truck without any restraint. I advised Mckay of my reason for stopping him and asked for his driver’s license, registration, and proof of insurance. Mckay was unable to provide me with any of the information I requested. As I collected Mckays personal information, he stated, “I’ll be honest with you sir, I don’t have a license.”

I provided dispatch with Mckay’s information and they confirmed he only had a Florida Identification Card. I issued Mckay a criminal citation for driving without a valid license and a civil citation for the child not being restrained in the vehicle. Mckay signed both citations without incident. All information pertaining to this case will be attached to this report. Nothing further.

 

Incident # 13-03170
On 03/17/13, at approximately 1333 hours, I was dispatched to WalMart, 2101 S Highway 77, in reference to a retail theft in progress. APA Derryl Whittemore advised dispatch that he was following a white male, later identified as Preston Nichols, concealing items inside the store. He advised the subject was approaching the grocery side exit. Whittemore described the male as being an older white male and wearing a large blue jacket.

I arrived at the store and stood outside to assist in the apprehension of the subject. Whittemore stopped Nichols in the vestibule of the grocery side and identified himself as security for Wal-Mart. At that time, Nichols pushed Whittemore in the chest and ran from the store.

I saw Nichols run out into the parking lot and noted that he matched the description Whittemore provided. As I began to chase Nichols on foot Whittemore exited the store and confirmed it was the suspect. I was able to catch Nichols on the north corner of the parking lot near, Chambliss Road.

I placed him in double-handcuffs and advised him he was under arrest. When I lifted Nichols from the ground a DVD fell from the inside of his jacket and onto the ground. Nichols was taken back to the store to be processed. I located the headphones under his jacket upon his chest. The DVDs were located in the front and rear of his pants.

Whittemore stated the following; at approximately 1315 hours he saw Nichols in the Hardware Department of the store. At that time, he collected a Stanley Fat Max Battery and concealed it in his jacket. He then proceeded into the Electronics Department and selected an X360 Primer Headphones, which he cut from a security peg.

Nichols collected numerous DVD’s and proceeded to the Infant Department where he cut open the package for the headphones and concealed them on his person. He then concealed the items in the front of his pants and traveled to the front of the store passing all points of sale. Nichols entered into the male restroom and then exited from the Grocery Side. The Stanley Fat Max Battery was later located in the restroom along with other empty packages.

Whittemore provided me with a sworn witness statement attesting to these facts. Whittemore stated he wanted Nichols trespassed from the store. I issued and explained to Nichols the trespass warning. He stated he understood but was unable to sign the warning due to being in handcuffs. The original trespass warning was provided to dispatch and a copy will be attached to this report. I then placed Nichols in the rear of my patrol vehicle and transported him to the Bay County Jail without incident. All information pertaining to this incident will be attached to this report. Nothing further.

 

Incident # 13-03186
On 3/18/13 at approximately 0348 hours, I was southbound on SR 77 approaching the intersection of Baldwin Road. A white Chevrolet pickup bearing Florida Tag PA228Y was in front of my patrol car. I observed the passengers seat belt buckle through the rear window of the vehicle.

I initiated my overhead lights for the offense as the vehicle passed through the intersection of Baldwin Road. The vehicle continued southbound on SR 77 and stopped in the 2800 block. I made contact with the driver, Fred Caldwell, and the passenger, Brad Lackey. I advised both the reason for the stop. Caldwell advised he was not wearing his safety belt as well.

I asked him for his drivers license and he told me it was suspended for child support, so he did not have his license. He gave me his name and date of birth and I confirmed his identification through DAVID. I confirmed his drivers license status through NCIC and delivered the information to dispatch.

Dispatch advised me of an outstanding felony warrant for Caldwell. I made contact with Caldwell and placed him under arrest for the outstanding warrant and secured him in double locked handcuffs. I then placed him in the rear seat of my patrol car. I advised him the vehicle would be towed. I completed a tow sheet on the vehicle before releasing it to Gulf County Towing.

The vehicle was towed to Gulf County’s tow yard. I gave Lackey a verbal warning for the seat belt violation, and he left the scene on foot. I transported Caldwell to the Bay County Jail without incident where he was booked on the charge of driving while license suspended, with knowledge, and the outstanding warrant. All documents pertaining to this case are attached.

 

Incident # 13-03206
On 03/18/2013 at about 1429 hours I was dispatched to 1109 Colorado Avenue in reference to possible identity theft. When I arrived I made contact with Ruth E. Peavy.

Peavy told me she received a vacuum cleaner with accessories and a new credit card from Amazon.com in the mail.She said neither she nor her husband had ordered the vacuum or applied for an Amazon card. Peavy contacted Amazon, but they would not release any buyer information to her for the vacuum and accessories.

Peavy also told Amazon she did not open the credit card account and that she wanted it canceled. Amazon said $237.55 had been charged to the card for business services, but were unable to provide any other information on the charges.

Peavy also received a welcome letter from Ally Bank, thanking her for opening a new account. Peavy contacted Ally and they told her the account was opened with her name, current address and with an email account of ruthpeavy@invox.com.

Peavy told them this was not her email address and had the account canceled. Peavy has opened an account with LifeLock.com and they are monitoring her credit for any suspicious activity. Peavy provided me with paperwork showing the fraudulent accounts and they will be attached to this report. No further information at this time

 

Incident # 13-03209
On 03/18/2013, at approximately 1540 hours, I was on patrol in my marked patrol vehicle at 2101 South Highway 77 in the Walmart parking lot. I observed a white female, that I recognized as Laura Remillard, walk past my patrol vehicle and into the department store.

I previously arrested Laura on 07/01/2013 for retail theft at the Lynn Haven Walmart. After the arrest, she was trespassed by Walmart security and I informed her to not return to the store. She also signed a trespass warning acknowledging the warning.

I entered the store and located Laura with her friend, Ian Michael Todd, in line at the customer service desk waiting to return some items they had in a plastic Walmart bag. I made contact with Laura and informed her that she had been trespassed from the Lynn Haven Walmart. She asked that I do not take her to jail because she was just released 5 days ago.

I relayed Laura’s information to dispatch. Dispatch verified that Laura was trespassed from the store and was on probation for grand theft. I placed her under arrest and detained her in double locked handcuffs. Laura Remillard was transported to the Bay County Jail without incident.

It should be noted that Laura’s previous arrest at Walmart was for theft by stealing items then returning them to customer service for cash. After Laura was arrested, Ian Todd left the store without returning the merchandise. The merchandise appeared to be some clothing and a small gray router that was not in any packaging. He did not give a reason as to why he did not return the router.

Incident # 13-03219
On 3/18/13, at approximately 1931 hrs, I was patrolling in the area of Cain Griffin Park when I was flagged down by a male I recognized as Jamie King. He asked if I was looking for Sean Delaney. I told him I wasn’t, but before I could ask anymore questions, he ran off.

I asked dispatch to look up Sean Delaney in local warrants. They did so, and advised me that he had a warrant for aggravated domestic battery with a deadly weapon.

I circled around the park, which was busy with a baseball game in progress, and people playing tennis and basketball. I made contact with King on the north side of the park by the concession stand. I asked him where Delaney was, and he pointed to a male standing in the park talking on the phone.

I approached the male, and asked him if he was Sean Delaney. He stated that he was. I told him he was under
arrest, and to put the phone down. He refused, saying he was talking to his father. I told him again to put the phone down, and took his right wrist to bring it behind his back.

He pulled away from me. I grabbed both his wrists, telling him again to put the phone down and bring his hands behind his back. He pulled away from me, moving forward and trying to pull his arms free. After a brief struggle, I took him to the ground in order to handcuff him.

Once I had him handcuffed, I asked if he had any weapons on him. He told me had two knives on him. He also told me he had a handcuff key on him. Once Officer Antunovic arrived, we took him to my car and searched him. The knives were in his front right pocket and the handcuff key was on his key chain. I picked up Delaney’s phone from where it had fallen to the ground during the struggle.

I noted the screen was cracked, although it is unknown if it was already cracked before the incident.
I transported Delaney to the Bay County Jail. Delaney saw the phone at the jail, and did not mention the cracks. Delaney’s bicycle was transported to the police department by Officer Antunovic. I placed it in the impound yard for safekeeping after making sure it wasn’t stolen.

 

Incident # 13-03242
On 03-19-13 at about 1031 hours, I was dispatched to Sonic located at 1508 S Hwy 77 Lynn Haven, FL in reference to a vehicle hitting the building and damaging it. The complainant and store manager Suzette Davis advised the vehicle was a white box truck with a lift on the back.

I arrived at Sonic and began to take information. I observed video from Sonic of the van hitting the building and driving off. Officer Pittman informed me via radio that he located a white box van at Mcdonald’s located at 1710 S Hwy 77 Lynn Haven, FL.

Officer Pittman relayed the FL tag of BQSR59 to dispatch. I arrived and noticed the truck had a matching Panama City sign on the back side with black lettering like the video from Sonic displayed. A white male later walked out of McDonald’s and I asked him why he did not stop when he hit the building at Sonic.

The male, later identified as Christopher Hardy, advised he thought he just scraped the top of the building. I completed a traffic crash form and a criminal citation for leaving the scene of a accident with property damage. I spoke with the vehicle’s owner, Brandon Joins, on the phone and advised him of the incident.

Christopher agreed to the court date and signed the citation. I returned to Sonic and supplied the traffic crash information. A traffic crash long form has also been completed. Long form number 76003884.

 

Incident # 13-03278
On 3/20/13 at 08:48 I was dispatched to the BP Station located at 2520 S. Hwy 77 in reference to a battery. Upon arrival I made contact with the complainant Rosie Willis who stated that she was in the car with her ex-boyfriend Leroy Green II when they began to argue.

Ms. Willis went on to say that she became so upset that she threw her glass of tea on Mr. Green. Mr. Green then grabbed her by the hair and forced her head down into the seat. Ms. Willis states that she attempted to make Mr. Green let her go by grabbing at his face. While Ms. Willis’ hand was in Mr. Green’s face he bit her on the left hand leaving bite marks. A short time later Mr. Green forced Ms. Willis out of the vehicle and left the scene.

Ms. Willis advised that she did not want to press charges and agreed to sign a declaration of intent.

I next spoke to Mr. Green who advised that he and Ms. Willis pulled into the gas station to get gas when they began to argue. Mr. Green advised that Ms. Willis threw tea on him and began hitting him in the face. In order to protect himself Mr. Green advised that he grabbed Ms. Willis by the hair and held her head down.

Mr. Green went on to say that Ms. Willis continued to try and hit him in the face so he bit her on the hand to make her stop. Mr. Green said that once Ms. Willis calmed down he made her get out of his vehicle and left the scene. Mr. Green advised that he did not wish to press charges against Ms. Willis and agreed to sign a declaration of intent. The declarations of intent were completed and no further action was taken.
