Judge Fensom dismissed a major drug case today after Bay County Sheriff’s deputies broke several laws to obtain evidence. He admonished the Sheriff’s Department for destroying evidence and attempted to cover it up in order to gain a conviction at all costs.
In his order dismissing the felony charges against Jeffery Gage, Judge James Fensom called the Sheriff’s Departments conduct “outrageous” and found that deputies “acted in bad faith” with “an ulterior motive.”
Misconduct included the planting of a GPS device without a warrant, trespassing to change the batteries in the GPS unit, searching a shed without a search warrant, and failure to disclose the GPS tracking device for over 6 months after Jeffery Gage’s arrest.
